Woman accused of drunk driving after fatal I-291 crash

A woman was arrested recently for a number of criminal offenses after an early morning fatal accident on I-291. The Massachusetts authorities say that the woman ran into the back of a tractor-trailer, resulting in the death of her passenger. The investigators suspect that the woman's behavior was due to drunk driving.

Both vehicles were heading east on the Interstate in Springfield. The big rig pulled over off of the Interstate and onto the roadside for reasons that were not reported. Subsequently, a 2011 Nisan Altima was said to have crossed over the line and rear-ended the truck. The 22-year-old driver of the Altima had to be transported to an area hospital. Her 25-year-old passenger, however, was pronounced dead at the scene of the crash.

After the driver was released from the hospital, she was arrested and charged with drunk driving, operating under the influence of liquor and other traffic violations. It was not reported whether any testing was administered to the driver to determine her blood alcohol content, though that is normally the procedure following a fatal accident. The crash is still being investigated.

While the crash is indeed a tragedy, in order to obtain a conviction, the prosecution will need to present sufficient evidence in a Massachusetts criminal court to prove the woman's guilt beyond a reasonable doubt. In view of the serious consequences the young woman is facing if a conviction were to be obtained in her drunk driving case, her defense team will need to carefully scrutinize all the evidence that the prosecution plans to use against her in court. In that manner, challenges to specific items of evidence may be prepared for presentation to the court prior to trial, and decisions may be made to adopt a defense strategy that will best fit the personal interests of the accused woman.
