Man charged with DUI after crashing into utility pole

A Massachusetts man was facing a DUI charge after he was involved in a car accident on Jan. 1. According to the police report, the 29-year-old man crashed into a utility pole on Jocyln Avenue at 1:55 a.m. in Framingham.

When authorities talked to him, he claimed that he was the one driving and that he had drunk alcohol prior to the crash. He reportedly blew a .17 on a portable breath test, though he refused to take a Breathalyzer test. As such, his license was automatically suspended.

He was ultimately charged with DUI of alcohol and for driving to endanger. He was also cited for a marked lanes violation. When he was arraigned on Jan. 3, he told the judge that there were sufficient facts to support the DUI accusation. He was reportedly due to return the court for his restitution hearing on March 3.

People who have been accused of driving while intoxicated can potentially face serious consequences if a conviction is obtained, including fines, restitution and incarceration. As a result, it can be advisable for them to seek the assistance of a criminal defense attorney as soon as possible in order to see how the allegations can be combated. One possible challenge could be that the breath machine was improperly calibrated. In other cases, the attorney could object to the traffic stop itself as not being conducted with the required reasonable suspicion that a law was being broken.
