Man charged for several felonies after drug raid

A Massachusetts man was detained on Sept. 17 after police executed a search warrant to look for drugs at his home in Yarmouth Port. The 27-year-old man was handed several drug charges that included multiple felonies. During the raid, authorities seized alleged marijuana, several different types of pills, $665 in cash, a semi-automatic pistol and a box of ammunition.

The search of the man's home began at 6:15 a.m. and was conducted by Yarmouth narcotics detectives, officers from the Massachusetts State Police Cape Cod Drug Task Force, members of the Cape Cod Regional SWAT Team and officers from the Federal Bureau of Alcohol, Tobacco, Firearms and Explosives. Authorities allegedly found Clonazepam, Amphetamine, Alprazolam and Lorazpem pills. They also seized Suboxone strips and M. Amphet salt capsules.

As a direct result of the search and seizure, the man was charged with three counts of second-offense felony distribution of a Class B substance, three counts of felony distribution of a Class C substance and one count for felony distribution of a Class D substance. He also received charges for felony armed career criminal, possession of a firearm without a Firearm Identification Card and unlawful storage of a firearm.

In cases like this one, the evidence that is seized by authorities will be a vital part of the prosecution's effort to obtain a conviction. If that evidence can be suppressed, the charges that stemmed from its discovery may end up being dropped. A criminal defense attorney might be able to file motions to dismiss evidence that was seized during a drug raid by arguing that police officers acted unlawfully during the operation.
