Massachusetts woman challenges OUI near tree lighting ceremony

A Massachusetts woman now faces criminal charges after striking another vehicle that was reportedly backing out onto the road in front of her near a community tree lighting event. An officer witnessed the collision and proceeded to perform field sobriety tests, which the woman allegedly failed. Facing charges of OUI, the alleged drunk driver will be back in court soon for her hearing.

While driving under the influence is prohibited under Massachusetts law, it is important to remember that every person remains innocent until proven guilty during the criminal justice process. Criminal defendants have the right to fight the charges made against them. Alternatively, some may choose to reach a plea agreement with prosecutors in order to reach a more favorable outcome. In this specific case, the woman appears set to fight the charges.

The driver who is accused of driving under the influence of alcohol in this case pleaded not guilty at her recent court arraignment. She was later released on her own recognizance and given a future date to appear. This time may be spent building a solid defense to confront the charges.

Even though she reportedly submitted to a breathalyzer test and failed, she does still have options in this scenario. There may be a more favorable sentence that involves probation rather than jail time. The defense may even be able to have evidence dismissed once all involved have been questioned and the investigation concluded. Charges of OUI in Massachusetts could result in losing her license and possible hefty fines if not successfully challenged.
